Mellifluous’s Terms of Service (ToS) Regarding Art Commissions (v1.0)

- GENERAL TERMSThe final decision regarding the commission is mine.I allow up to three revisions during the sketching and lineart phase. If you request a fourth revision, a revision fee will apply before I can continue.You can choose to pay the full price before I begin your commission. This payment method is 100% non-refundable.The commission will not proceed until you pay all fees and provide proof of payment.Additional fees are not part of the final price and are 100% non-refundable as soon as they are paid for. Commercial fees are per use case. Each use needs its own license.You will describe the art piece you want and are required to provide references when asked. I do not accept commissions that are vague.You acknowledge that the art you commissioned belongs to me, and I retain all copyright and commercial rights to all commissioned artworks (until you pay the commercial fee). You are only commissioning me to use my art for your personal reasons and not own it.Unless stated otherwise, you grant me permission to showcase the finished art piece and/or a time-lapse or video of the process on my social media platforms.You may post the completed art on a public platform I am on and must credit me by tagging my account.You are not allowed to sell my art without my permission and paying for commercial rights. (see completion & use of my art)You acknowledge that I may display your commissioned piece in my portfolio. Non-negotiable.I reserve the right to discontinue, refuse your commission, or refuse to provide my services for any reason. (see my refusals and payment & refunds)Once you confirm that the line art is satisfactory and have paid for me to continue on to the line art, you are not eligible for a refund. (see payment & refunds)I do not allow my work to be used for AI training, AI generation, AI image modifications, or NFT use.I do not permit any type of modifications to my artworks.You acknowledge that I will record our transaction(s) and keep a record of our transactions.Any personal information that is shown during our transaction (e.g., name) is to be kept a secret between us and is not to be leaked.

- FOR YOU, THE CLIENTI will not purposefully leak your personal information.I will not use your personal information against you.I will not purposefully sell your personal information to a third party.You have the right to cancel and discontinue the commission at any point in time, and you have the right not to disclose the reasons for cancellation.You may ask for a refund (unless the lineart has been paid for).You can ask for updates.You have the right to choose whether or not to display your commissioned piece on my social media platforms.You can choose to request or decline being sent an invoice/receipt.You may use your real name or your online identity to sign this contract.You may share the completed artwork on any public platform I'm on, and you are REQUIRED to credit me by tagging my account. (see points of communication/social media platforms)

- MY REFUSALSI will not accept commissions with:
- Pornographic content.
- Illegal material (e.g., child pornography, torture, etc.)
- Fetishes.
- Violence and gore.
- Political/religious propaganda.
- Racist, homophobic, or overall offensive agendas.
- AI.I cannot and will not accept commissions with/that are:
- Complex perspectives.
- Complex backgrounds (like cities and skyscrapers).
- Furries.
- Mecha.
- Buildings/cities.
- Realism.
- Animation.
- Have short deadlines. (see estimated time of completion (ETC) & deadlines)
- Logos.
- Only sketches or linearts.
- AI.You may ask me directly if I am willing to accept a commission for your idea. I am willing to hear your ideas! My decision on whether or not I accept your commission(s) will be up to me.

- ESTIMATED TIME OF COMPLETION (ETC) & DEADLINESI typically require 1-2 weeks or more to complete a commission. However, this time frame will vary based on the complexity and difficulty of your request and my schedule. During school days, I require 3-4 weeks to complete a commission. Any delays to your commission will be announced as soon as possible.If you have a specific deadline, there will be a rush fee, so please let me know when you reach out.Ultimately, the estimated time of completion (ETC) is at my discretion. If I cannot meet your given deadline, I will decline the commission.If payment is not made within 5 business days, I reserve the right to discontinue your commission, but a late-pay fee of $5 / ₽50 will be applied before proceeding.If you do not respond to my inquiries within 10 business days, I may discontinue your commission.If I discontinue your commission, resuming will require a fee of $15 / ₽300.

- PAYMENT & REFUNDSI use GoTyme PH. From my understanding, it accepts payment from other online payment platforms (e.g., PayPal). Please note that I am relatively new to online transactions, and if there are any problems that arise, I am sorry in advance and am grateful for your patience!If you commissioned me in person, you can pay in cash. The option to pay in cash is not available if you are in a different continent, country, or city. Meeting up in person is not an option.1. 50% DOWN PAYMENT
After I accept your commission, you are required to pay 50% of the agreed-upon price before I start sketching.2. 30% AFTER LINEART
Once you have confirmed the lineart is satisfactory, you will need to pay an additional 30% of the agreed-upon price before I can continue on with the base colors. After paying, you are not eligible for a refund.3. PAY THE REMAINING 20% AFTER BASE COLOR
After I finish adding the base color, you will pay the remaining 20% of the agreed-upon price before I can continue and finish the commission. (see completion)If you decide to cancel, you may request a refund. In the case of requesting a refund, I will refund 35% and retain the remaining 65%. Please note that refunds are not available once the lineart has been approved as satisfactory, and the 30% has been paid.

- COMPLETION & USE OF MY ARTOnce you have paid the full agreed-upon price, plus additional fees, I will send you the completed artwork for you to save/download.You are permitted to use my art for personal use only, such as printing, creating pins, and posting on social media with credit. However, you are not allowed to use/distribute my art for commercial purposes, sell, or mass-produce it until you pay the commercial fee. You are REQUIRED to inform me if you are using my art for commercial use.

- IF YOU BREAK MY TERMS OF SERVICEBreaking my ToS at any given point in time will land your name on my blacklist. Your name on my blacklist will make you unable to commission me. If you want to be removed, it will be completely up to me.Commissioning me means that you have read the Terms of Service and agree to follow them.
